These Terms and Conditions ("Terms") govern your access to and use of the Achievr application on Meta Quest devices (the "App"), provided by Achievr ("we", "us", "our"). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The App is intended for use by individuals aged 13 and over, in accordance with Meta's platform requirements. Accounts within the App are typically provisioned by an organization administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
The App provides VR-based training sessions and related tools to organizations and their members. Access to training days or training sessions may be limited according to your organization's subscription plan or bundle balance, as configured by your organization administrator.
Virtual reality use carries physical risks. Before use, ensure you have a clear, obstacle-free Guardian boundary. Some users may experience motion sickness, dizziness, disorientation, seizures, or eye strain. Stop use immediately if you experience discomfort, take regular breaks, and consult a physician before use if you have a heart condition, are pregnant, are prone to seizures, or have any other condition that may be affected by VR use. Do not use the App while impaired, and keep the play area clear of other people, pets, and fragile objects.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse engineer, decompile, or extract source code from the App except as permitted by law; (c) interfere with or disrupt the App's infrastructure or other users' access; or (d) use the App to harass, abuse, or harm another person.
The App, including its software, design, and content, is owned by Achievr or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for its intended purpose, subject to these Terms.
If you access the App as a member of an organization, your organization administrator may be able to view, manage, or remove your account and associated usage data within the App.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Achievr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising from your use of or inability to use the App, including any physical injury resulting from VR use undertaken contrary to the health and safety guidance in Section 4.
We may suspend or terminate your access to the App at any time if you violate these Terms. Your organization administrator may also remove your access at their discretion.
We may revise these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles, unless otherwise required by the mandatory consumer protection laws of your jurisdiction.
